These Terms of Use (“Terms”) govern your access to and use of Driply (“Driply,” “we,” “us,” or “our”), a creator commerce platform that lets sellers list and sell digital and physical products. By creating an account, listing a product, or making a purchase, you agree to these Terms. If you do not agree, do not use Driply.
Driply provides tools for sellers to create storefronts, list products, accept payments, and deliver digital goods. Sellers — not Driply — are responsible for their products, descriptions, pricing, fulfillment, customer service, taxes, and legal compliance. Driply is a technology provider and is not the seller of items listed by creators.
Driply is free to start with no monthly fee. Driply charges a 5% platform fee on each successful sale, and the seller keeps the remaining 95%. The fee is applied automatically at the time of sale. We may change our fees with reasonable notice; continued use after a change means you accept the new fees.
Payments are processed by Stripe through Stripe Connect. By selling on Driply, you also agree to Stripe’s applicable terms. Payouts are handled by Stripe and sent to the seller’s connected account on Stripe’s schedule. You are responsible for providing accurate payout and tax information.
You may not use Driply to list, sell, or distribute:
You also may not attempt to bypass fees, abuse the platform, scrape data without permission, or interfere with the security or operation of Driply. We may remove content or suspend accounts that violate these Terms.
When you buy on Driply, your purchase is a transaction with the seller. Refunds, where offered, are handled according to the seller’s policy and applicable law. Digital products are typically delivered immediately and may be non-refundable unless otherwise stated. Do not redistribute purchased content unless the seller’s license permits it.
If you participate as an affiliate, you may earn a commission on qualifying sales you refer, subject to the seller’s program terms. Commissions are voided for refunded, fraudulent, or disputed orders. You must promote honestly and may not use spam, misleading claims, or self-referrals.
Sellers retain ownership of the content they upload and grant Driply a limited license to host, display, and deliver that content to operate the platform. The Driply name, logo, and software are owned by Driply and may not be used without permission.
You may stop using Driply at any time. We may suspend or terminate accounts that violate these Terms or that create risk or legal exposure for the platform or its users. Some provisions survive termination, including fees owed, intellectual-property terms, disclaimers, and limitations of liability.
Driply is provided “as is” and “as available” without warranties of any kind, express or implied. We do not guarantee that the platform will be uninterrupted, error-free, or that any particular sales or results will be achieved.
To the maximum extent permitted by law, Driply is not liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, data, or goodwill. Our total liability for any claim relating to the platform will not exceed the fees we collected from you in the three months before the event giving rise to the claim.
You agree to indemnify and hold Driply harmless from claims, damages, and expenses arising from your content, your products, your use of the platform, or your violation of these Terms or applicable law.
These Terms are governed by the laws of the jurisdiction in which Driply operates, without regard to conflict-of-law rules. We may update these Terms from time to time; when we do, we will revise the “Last updated” date above. Continued use after changes means you accept the updated Terms.
